I’m attaching some suggested wording for your convenience. It is not necessary to use this exact language word for word, but you are required to include something that involves the spirit or intent of the rule. Some of you might be saying, “What is this all about?” Well, we have had an inordinate amount of grievances filed over the past several years and frankly, some of these issues could have been solved at the local level. In many cases however, no honest attempts were made to resolve these issues. The Governing Council voted soundly that 1) There needs to be language added to club bylaws regarding conflict resolution by September 1, 2004; 2) Prior to filing a grievance though U.S. Figure Skating, you must prove that resolution at the local level was attempted; and 3) a fee of $125 is now required to file a grievance. It is the hope of the Grievance, Ethics and Membership Committees that this process, along with the new conflict management guide, will help organizations work through issues at the club level. Clubs that have gone through the Club Leadership and Business Management School have benefited from learning how to improve communications and relations with constituents and this has helped them out significantly. Here is the new rule and the suggested language for club bylaws. Rule To amend MR 4.03 as follows to become effective September 1, 2004: The constitution and bylaws of a club should be in a form similar to the constitution and bylaws approved by the USFSA for member clubs, including a conflict resolution process, or in such form... To amend MR 6.03 as follows to become effective September 1, 2004: Maintain a duly adopted constitution and/or bylaws which contains suitable provision for the election of officers and directors, a conflict resolution process and the conduct of its affairs...[balance is unchanged] Suggested wording for club bylaws: Article: Conflict Resolution If any club member(s) has a complaint against another member(s) for an infraction of any bylaw or rule other than skating rules, they may file such complaint in writing to the board.
